Purposes and legal basis for the processing of personal data

The purpose of the processing is to fulfil the public tasks assigned to us by law, in particular to inform the public.

Unless otherwise stated, the legal basis for the processing of your data results from Art. 4 para. 1 of the Bavarian Data Protection Act (BayDSG) in conjunction with Art. 6 para. 1 subpara. 1 letter e of the General Data Protection Regulation (GDPR). Accordingly, we are permitted to process the data required to fulfil a task incumbent upon us.

Duration of storage of personal data

Your data will only be stored for as long as is necessary for the fulfilment of tasks, taking into account statutory retention periods.

Your rights

If we process your personal data, you have the following rights as a data subject:

You have the right to information about the personal data stored about you (Art. 15 GDPR).
If incorrect personal data is processed, you have the right to rectification (Art. 16 GDPR).
If the legal requirements are met, you can request the erasure or restriction of processing (Art. 17 and 18 GDPR).
If you have consented to the processing or a contract for data processing exists and the data processing is carried out using automated procedures, you may have a right to data portability (Art. 20 GDPR).
If you have consented to the processing and the processing is based on this consent, you can revoke your consent at any time for the future. The legality of the data processing carried out on the basis of the consent until the revocation is not affected by this.

You have the right to object to the processing of your data at any time for reasons arising from your particular situation if the processing is carried out exclusively on the basis of Art. 6 para. 1 letter e or f GDPR (Art. 21 para. 1 sentence 1 GDPR).

Logging

When you access this or other Internet pages, you transmit data to our web server via your Internet browser. The following data is recorded during an ongoing connection for communication between your Internet browser and our web server:

  • Date and time of the request
  • Name of the requested file
  • Page from which the file was requested
  • Access status (file transferred, file not found, etc.)
  • Web browser and operating system used
  • complete IP address of the requesting computer
  • amount of data transferred.

We store this data for reasons of technical security, in particular to defend against attempted attacks on our web server. After seven days at the latest, the data is anonymised by shortening the IP address at domain level so that it is no longer possible to establish a reference to individual users.

To prevent threats to information technology security, the data is forwarded to the State Office for Information Technology Security and processed there on the basis of Art. 12 ff. of the Bavarian E-Government Act.

Active components

We use active components such as Javascript, Java applets or Active-X controls. You can switch off this function by changing the settings in your Internet browser.

Cookies

When you access this website, we store cookies (small files) on your device that are valid for the duration of your visit to the website (‘session cookies’). We only use these during your visit to our website. Most browsers are set to accept the use of cookies. However, you can switch off this function for the current session or permanently by changing your browser settings. At the end of your visit, your browser will automatically delete these cookies.

Integration of YouTube videos

Videos from the external video platform YouTube are integrated on our website. By default, only deactivated images from the YouTube channel are embedded, which do not establish an automated connection with the YouTube servers. This means that the operator does not receive any data from the user when the web pages are accessed.

You can decide for yourself whether the YouTube videos should be activated. Only when you authorise playback of the videos by clicking on ‘Permanent activation’ do you give your consent for the necessary data (including the Internet address of the current page and the user’s IP address) to be transmitted to the operator.

In order to save the setting requested by the user, we set a cookie that saves the parameters. When these cookies are set, however, we do not store any personal data; they only contain anonymised data for browser customisation. The videos are then active and can be played by the user. If you would like to deactivate the automatic loading of YouTube videos again, you can uncheck the consent box under the data protection symbol. This will also update the cookie settings.

YouTube is a service provided by YouTube LLC, 901 Cherry Ave, San Bruno, CA 94066, USA, a subsidiary of Google Inc, 1600 Amphitheater Parkway, Mountainview, California 94043, USA. Facebook does not conclusively and clearly state how it uses the data from visits to Facebook pages for its own purposes, to what extent activities on the Facebook page are assigned to individual users, how long Facebook stores this data and whether data from a visit to the Facebook page is passed on to third parties, and we are not aware of this.

When you access a Facebook page, the IP address assigned to your end device is transmitted to Facebook. According to Facebook, this IP address is anonymised (for ‘German’ IP addresses) and deleted after 90 days. Facebook also stores information about the end devices of its users (e.g. as part of the ‘login notification’ function); this may enable Facebook to assign IP addresses to individual users.

If you are currently logged in to Facebook as a user, a cookie with your Facebook ID is stored on your end device. This enables Facebook to recognise that you have visited this page and how you have used it. This also applies to all other Facebook pages. Facebook buttons integrated into websites enable Facebook to record your visits to these websites and assign them to your Facebook profile. Integration of YouTube videos and social plugins

When you visit our website, additional services from YouTube and social plugins (e.g. Twitter, Facebook and Google+) are offered via a so-called two-click solution. When the website is accessed for the first time, no data is transmitted to the operators. Data (including the URL of the current page and the user’s IP address) will only be transmitted to the respective operator after the user has clicked on (name of Internet address) to consent to the opt-in procedure. As a user, you can therefore decide for yourself whether you consent to the activation of these offers and the transfer of data. The user can revoke this consent at any time and prevent further data transmission to the operators by clicking on the corresponding button on the homepage (opt-in procedure).

Integration of Facebook Like button
By default, only deactivated buttons are displayed, which do not yet establish contact with the Facebook servers. Only when you declare your consent with a second click will the connection be established and your ‘Like’ transmitted to Facebook. Only if you are already logged in to Facebook will your ‘Like’ be transmitted without another window.

Evaluation of user behaviour (web tracking systems; reach measurement)

Use of Matomo – formerly PIWIK

We use a 2-click solution: We only use programs to evaluate user behaviour if you have consented to the opt-in procedure by clicking on the corresponding button. No data is transmitted to the operators when you first access the website. Only after you have consented to the opt-in procedure by clicking on the appropriate button will your IP address be anonymised immediately and on each subsequent visit and then evaluated by us or transmitted to third parties for evaluation.

As part of our press and public relations work, photos are taken at events and appointments in which you may be recognisable. You can object to the recording and/or publication.

Electronic mail (e-mail)

Information that you send to us unencrypted by electronic mail (e-mail) may be read by third parties during transmission. As a rule, we are also unable to verify your identity and do not know who is behind an e-mail address. Legally secure communication by simple e-mail is therefore not guaranteed. Like many e-mail providers, we use filters against unwanted advertising (‘SPAM filters’), which in rare cases automatically categorise normal e-mails as unwanted advertising and delete them. E-mails containing harmful programmes (‘viruses’) are automatically deleted by us in all cases.
